About this Visa-Temporary Work Permits.

Each year over 90,000 Foreign Workers come to Canada to work temporarily, helping Canadian employers address skill shortages in Canada . In almost all cases you must have a valid Work Permit to work in Canada.A work permit allows you to work at a specific job, for a specific period of time, for a specific employer.

These steps must be followed before you apply for a Work Permit:

1.      An employer must first offer you a job.

2.      Service Canada (SC) must normally provide a Labour Market Opinion, or a confirmation of employment.

Provincial Nominee Programs-FAQ.

Q. What is the Provincial Nominee Program (PNP)?

A. PNPs are immigration programs under which a specific province selects individuals from other countries and nominates them to the federal government for landed immigrant status. The eligibility criteria reflect the specific needs of that province’s labour market and economy.

Q. Which provinces have PNP Programs?

A. The provinces that have PNPs are: British Columbia ; Alberta ; Saskatchewan ; Manitoba ; Nova Scotia ; New Brunswick ; Newfoundland and Labrador; and Prince Edward Island . Quebec has a special separate immigration program.

Q. How do I apply under a PNP?

A. In PNP applications, the first step is for the application to be approved by the province. In most cases this first step is completed quickly. The provincial processing time can range from two weeks to nine months depending on the province. PNP approval is commonly called being “nominated” by the PNP. After the PNP approval, federal approval consisting basically of police, medical and security checks; these are still required as they are under the federal program. This may take 6-8 months depending on the CIC post. After the PNP nomination has occurred, a PNP can assist the nominee to obtain a work visa on an expedited basis.

Q. Do I need to meet the eligibility requirements of federal immigration classes?

A. No. The specific PNP’s eligibility criteria will be used to assess your application. You will, however, be subject to the federal government’s health, security and criminality reviews, and could be asked to supply additional information to CIC. In some cases, individuals may be approved under a province’s criteria that would normally be refused under federal immigration classes.

Q. How long will it take to get a visa under the PNP?

A. Processing times vary; however, successful PNP applications typically receive visas considerably quicker than individuals applying through federal immigration classes.

Q. Will I be interviewed by a federal immigration officer?

A. This is unlikely.

Q. Where do I submit the PNP application?

A. Directly to the PNP office in Canada that you are applying.

Q. Am I required to get a medical check done?

A. Yes. If you are nominated under the PNP, you will receive instructions from the Canadian visa office on how to get medical examinations done for you and your family members.

Q. Will background checks be done on me?

A. Yes. PNP nominees and their adult family members undergo security and criminality screening by CIC, as do all other immigrants to Canada . This will occur when your nomination is forwarded to the federal government by the province that is nominating you.

Q. What financial assets do I need under the PNP?

A. Federal guidelines recommend that immigrants arrive with a minimum of CDN$10,000 per primary applicant plus CDN$2,000 for each dependent, or some other source of financial support in Canada . However, this requirement is waived if you have an offer of employment in Canada as is required by most PNPs for skilled workers.

Q. I have applied for refugee status in Canada . Can I also apply under PNP?

A. No. PNP will not process applications by individuals who are applying in any other immigration category, including a refugee claim.

Q. I am working in Canada on a Work Permit and may qualify in a PNP category. Could I be considered under PNP?

A. Yes, most PNP programs accept applications from individuals working in that province with a valid Work Permit.

Q. Can I apply for a Work Permit and go to Canada prior to submitting a Provincial Nominee application?

A. Yes, most PNP programs accept applications from individuals working in that province with a valid Work Permit. In fact, for certain PNPs your chances of qualifying are a great deal higher if you are already working and living in that province. In most cases, application processing can be completed from within Canada .

Q. Do I need to get my trade or profession credentials recognized in Canada before applying under PNP as a Skilled Worker?

A. You must provide documented proof of your education, training, occupational credentials and/or work experience that show you can become eligible to work in your occupation in Canada after your arrival. If necessary, PNP program officers may ask you to have your credentials reviewed by a qualification assessment organization or the regulatory body responsible for your occupation in that province. In certain situations, they will require that the applicant has met all licensing/regulatory requirements.

Q. If a skilled worker is nominated and approved by a PNP Program, is a visa automatically issued by Citizenship and Immigration Canada ?

A. All individuals approved as provincial nominees, and their accompanying dependents, are subject to the standard Citizenship and Immigration Canada assessment which includes, but is not limited to, federal statutory requirements for criminal, security and health checks. An approval by a PNP does not ensure a visa.

Q. Can my family members accompany me to Canada ?

A. Yes. As an approved provincial nominee candidate, immediate family members may immigrate with you - your spouse and your dependent children. Just be sure immigration processing fees are paid for all your dependents. Citizenship and Immigration Canada (CIC) will process the dependent's/s’ applications at the same time as yours, also making sure they meet all mandatory federal immigration requirements such as criminal, security and health checks. All immediate family members should be included on your CIC application form (whether they accompany you or not). All accompanying family members 18 and over must submit separate application forms.

Q. Is there a fee for submitting my application to a PNP Program?

A. Most provincial nominee programs do not charge application fees. However, successful candidates will need to pay a processing fee to Citizenship and Immigration Canada when they apply for their immigrant visa(s). They will also need to pay the "Right of Permanent Residence Fees" in order to gain final Permanent Resident status. Q. How would my application be assessed under a PNP Program? What factors are considered?

A. Each program assesses you according to different criteria and has difference selection factors, but in general, the PNP program will want to ensure that:

  • You have the necessary education, skills, and work experience for employment in the occupation in which you are applying.
  • You have the employment qualifications required by the employer and industry standards.
  • You have a bonafide intention to settle in that province

 

 

Work Permits and Provincial Nominee Programs (PNP)

Normally, applying for a visa under a PNP process is a two-step process. The first step is for the applicant to be approved or “nominated” by a specific PNP. After PNP approval, the next step is for the applicant to submit an application for a Permanent Resident Visa is his or hers country of residence. This takes 6-8 months depending on the CIC post.

However, after nomination a PNP can also assist the nominee to obtain a Work Permit on an expedited basis. The PNP program will have to send a letter to the CIC post stating that the nominee is eligible for a Work Permit. As an approved provincial nominee, the Work Permit can be issued without first obtain a Labour Market Opinion from Service Canada (SC). Typically the work permit option is available for persons applying to a PNP for Skilled Workers with an Offer of Employment. However, some PNP for Business will also issue a Work Permit request for business nominees.

What does a Provincial Nominee visa give me?

If your application is successful, you will be granted permanent residency in Canada . As a Permanent Resident, you have the right to live, work and study in Canada indefinitely.

Applications for permanent residence in Canada will include the principal applicant and all of his her dependants. This means the applicant may bring his or her spouse and dependent children to Canada .

You and your family members will receive immediate entitlement to public healthcare, administered through the province in which you will be living. Children are eligible to attend public (government-funded) schools in Canada . Generally, Permanent Residents can work for any employer in any occupation.

After living in Canada for at least three years as a Permanent Resident, you may decide to apply for Canadian citizenship, or you can continue to retain your current citizenship. As a Canadian Citizen, you will be eligible to obtain a Canadian Passport.

Priority Processing.

The main advantage of applying to a Provincial Nominee Program is that your application for permanent residence in Canada will be processed considerably faster than if you apply to the Federal Skilled Worker Program.

The reason for this is that successful Provincial Nominee Program applicants are issued a Nomination Certificate, which means they have been selected by that Province. Their application for permanent residence is then forwarded by the province to the Canadian Embassy handling their application, and they are requested to provide security background checks and to take a medical examination before issuing a Permanent Resident visa.

The process to obtain a nomination certificate varies according to the province but on average can take between 1 and 8 months. The amount of time it takes to complete the required medical checks and security clearance varies according to which embassy is responsible for processing - but it is 7 months on average. This means that most Provincial Nominee Program applicants can have their visa processed between 8 and 15 months. Proving Language Ability

The best way to prove language ability is to take a language proficiency test given by an organization approved by Citizenship and Immigration Canada (CIC). You will then be able to determine how many points you will receive for the language factor, according to your test score.

You Must:

  • Make arrangements for testing by an approved organization (you are responsible for the costs).
  • Include the test results with your immigration application.

What Does a Skilled Worker Visa Application Give Me?

If your application is successful, you will be granted Permanent Residency in Canada . As a Permanent Resident, you have the right to live, work and study in Canada indefinitely.

Your children will be eligible to attend all public (government-funded) schools in Canada . Generally, Permanent Residents can work for any employer in any occupation. You, your spouse, and your children will also be entitled to apply for post-secondary government loans, scholarships, grants and bursaries to subsidize the cost of post-secondary education. You, your spouse, and your children are also entitled to apply, in case of need, for pension and social welfare benefits available under Canada ’s vast social services infrastructure.

After living in Canada for at least three years as a Permanent Resident, you may decide to apply for Canadian citizenship, or you can continue to retain your current citizenship. As long as there are no restrictions from your country of origin, you may choose to retain multiple citizenships upon obtaining Canadian citizenship. As a Canadian Citizen, you will be eligible to obtain a Canadian passport which allows visa-free and hassle-free travel to the majority of countries in the world.

Skilled Worker Immigration Options

If you wish to immigrate to Canada as a Skilled Worker, there are three basic options:

  • The Federal Skilled Worker program
  • Provincial Nominee Programs (PNPs).

Both the Federal Skilled Worker Program and Quebec Skilled Worker Program are independent immigration programs, which means that you do not need a job offer in Canada in order to qualify - although having a job offer may increase your chances of qualifying.

If you wish to live in any province except Quebec , you should apply to the Federal Skilled Worker Program. If you would like to live in the Province of Quebec you should apply to the Quebec Skilled Worker Program. Both programs are points based under which applicants are awarded various points based on a number of factors including age, education, work experience, language ability and other determinants.

You need to obtain a certain number of points, i.e. “the Passing Mark”, in order to qualify.

Provincial (Immigration) Nominee Programs (PNPs) that allow expedited immigration processing to meet provincial labour and economic needs have been set up in most provinces in Canada . These programs allow accelerated processing for Skilled Workers that have a job offer from a local provincial business in a designated occupation or business sector.

The provinces that have a Skilled Worker PNP are:

British Columbia ; Alberta ; Saskatchewan ; Manitoba ; Nova Scotia ; New Brunswick ; Newfoundland and Labrador; and Prince Edward Island . People wishing to live and work in Quebec must apply under the Quebec Program; those wishing to work and reside in the Province of Ontario need to apply under the Federal Skilled Workers Program.

The big advantage of applying to a PNP program is twofold:

  • Skilled Workers can often qualify under a PNP who would not pass under the Federal or Quebec Skilled Worker Programs
  • PNPs have much faster processing time of 8 to 12 months on average (compared to the Federal Skilled Worker Program which takes 24-36 months to process on average).

Federal Skilled Worker Program

Skilled Worker immigrants are chosen for their ability to become successfully established in Canada . New selection criteria place more emphasis on applicants' education and skills such as language rather than on their intended occupation.

To be accepted as a Skilled Worker, you must:

  • Meet the language skills requirement (the ability to communicate at work in one or both of Canada ’s official languages is very important)
  • Meet the minimum work experience requirements
  • Prove that you have the funds required for settlement (it is necessary for Skilled Workers to have sufficient fund to support themselves and their families upon arrival in Canada )
  • Earn enough points to meet the pass mark in the six selection factors.

Eligible Occupations

Your education and work experience must be in an occupation that is in the in the category of Skill Type 0 , or Skill Level A or B on the Canadian National Occupational Classification (NOC). The Federal Occupations List contains the complete list of jobs that meet these criteria. If you occupation is not on this list, then you are not eligible to apply for the Federal Skilled Worker Program. However, you many still qualify to a Provincial Nominee Program for Skilled Workers.

Minimum Work Experience Requirements

You must meet the following minimum work experience requirements in order to apply as a Skilled Worker:

  • You must have at least one year of full-time paid work experience within the last 10 years
  • You must have had this experience within the last 10 years.

If you do not meet the minimum work experience requirements, you are not eligible to apply as a Skilled Worker.

Points Test

The current pass mark is a minimum of 67 points. If you have 57 or more points, you may still be able to apply for this program if you obtain an Arranged Employment Opinion. You may also consider applying to a Provincial Nominee Program (PNP) as these programs are usually employer driven and do not involve a points test or mandatory English testing.
